FAR & DFARS ADDITIONAL TERMS AND CONDITIONS CLAUSE

  1. Definitions. As used in this clause –
    • “Commercial item” assumes the meaning defined in Federal Acquisition Regulation 2.101.
    • “Subcontract” involves a transfer of commercial items between divisions, subsidiaries or affiliates of the contractor or subcontractor at any tier.
  2. The FAR, or Federal Acquisition Regulation, clauses may be found in entirety at https://www.acquisition.gov/. The DFARS, or Defense Federal Acquisition Regulation Supplement, clauses may be found in entirety at https://www.acq.osd.mil/dpap/dars/dfarspgi/current/index.html
  3. These clauses are in addition to, not in place of, Sandstrom’s Terms & Conditions for Fulfillment of Purchase Order.
  4. The contractor, and subsequent subcontractor at any tier, shall include the terms of this clause (d) and the following clauses in subcontracts for commercial items awarded under this contract (a.k.a., purchase order):

This contractor and subcontractor shall abide by the requirements of 41 CFR 60-741.5(a). This regulation prohibits discrimination against qualified individuals on the basis of disability, and requires affirmative action by covered prime contractors and subcontractors to employ and advance in employment qualified individuals with disabilities.
